The RCMP has charged a 55-year-old man with impaired operation and failure to comply with the conditions of his release order after a concerned citizen called police on Tuesday to report a suspected impaired driver.

Just before 2:30 p.m. on Tuesday, officers responded to a call about a driver who appeared to be under the influence of alcohol outside a quick-service restaurant on the Trans-Canada Highway in Whitbourne.

When police arrived, they located the vehicle and the driver — 55-year-old Daniel Gillingham — in the parking lot, and arrested him for failing to comply with a release order barring him from operating a motor vehicle on a highway and being under the influence of alcohol outside of his home.

Gillingham provided breath samples confirming his intoxication by alcohol. Police also located an open container of alcohol in his vehicle.

He was held in police custody overnight and is expected to appear in court today on charges of impaired operation over 80mg% and failure to comply with a release order.

His driver’s licence was suspended, and the vehicle was seized by police and impounded.
